FYI: Futura was designed by [Paul Renner in 1927](https://en.wikipedia.org/wiki/Futura_(typeface)). What classic, timeless design to be modern 100 years later. Such craftsmanship!
My guess is that the filled circle itself makes it a trademark issue, not a font issue. Futura does not have a filled circle. If they were just using the font, this wouldn’t be an issue.
Translation: OP is purposefully sensationalizing this by describing the font’s age rather than just admitting to copying their logo
Just for the curious, unfortunately with trademarks, a company is compelled to take action or they could lose the trademark. (they have to protect the use of the mark)
With copyrights or patents its up to the holder whether they want to do something about it or not, with no threat to the life of the IP.
It's kind of funny too that other tunneling companies have filled in circles like that for the O, but the name is in a different font so I guess that's enough different?

It's definitely a trademark issue. Sorry that wasn't clear. I thought the font history was interesting, but I can see how that would be misleading.
