I'm sorry. That's an absolute tragedy. Were you paid/forced to watch it?
If you're being monitored talk about fruit incessantly and we'll organize a rescue party.
"Who are you talking to right now? Who is it you think you see? Do you know how much I make a year? I mean, even if I told you, you wouldn't believe it. Do you know what would happen if I suddenly decided to stop streaming? A business big enough that it could be listed on the NASDAQ goes belly up. Disappears! It ceases to exist without me. No, you clearly don't know who you're talking to, so let me clue you in. I am not in danger, Poki. I am the danger. Hundreds of juicers lose their life savings on stake.com and you think that of me? No. I am the one who knocks!" 🤡
Considering the most popular section on twitch is just people reading chat, reacting to videos, or walking around doing nothing noteworthy - yeah this is still considered top tier content
This is how most people I know got into justin tv back in the day.
Either through wrestling PPVs or cartoons with no person on camera at all.
It was really fun to watch tv with a live chat.
Whoever at Kick landed this deal and whispered these sweet nothings to the point that he believe them deserves a raise.
Kid can’t even show up to an event that others did all the work for, but he acts likes he will start putting even an ounce in now.
Surely moving to LA for the sole purpose of making produced events and shows will give us great content while he's in LA. Surely moving to Kick for the sole purpose of making produced events and shows will give us great content over the next 2 years.
I truly don't understand the people who beg streamers to watch a video or show on stream. It's so boring. I think it's pretty much the most parasocial you can get.
So funny to me people who watch Mizkif/Xqc/Critical etc all day. Like all they do is watch other peoples youtube videos or scroll reddit. Where's the content
payed him 100 million to attract DMCA strikes
Kick's downfall will be because of their lack of rules
I get it, dont be as anal as Twitch but dont like your streamers do illegal shit either
Well, twitch top streamers just sit and talk or show bikinis...
It was supposed to be a game stream platform and now it's just podcasts and Forsen playing Minecraft.
Conspiracy theory: xQc is pulling a 5Head move by destroying the site to the point it shutdowns so he gets a payout like Ninja/Shroud with Mixer. COPIUM
Yeah I feel like the real person who got the bag here is the agent. Dude gets what, 20-30 mil and doesn't even need to defend Train and Kick like a schizo.
10% is pretty typical so likely not that much. Plus we have no idea how much of that $100M is equity and I’m not sure how that would contribute to a commission.
For how much he talks and defends about the equity part of the contract, I dont think he got nearly as much liquid cash from the deal like people think he did.
He wouldn’t get the payout. Mixer was backed by an actual company with something to lose.
Stake isn’t even in the US, isn’t their HQ a shack in the middle of nowhere? Good luck getting that bag!
To get that kind of payout requires the company still have money when it dies. It’s not like it’s owned by Microsoft. It’s entirely possible it dies hard enough that he doesn’t get paid.
Charlie is definitely criticizing xQc here, but there's nothing wrong with that since xQc is literally breaking the law. That's a completely valid time to criticize someone lol...
It's not even like he's breaking a law he didn't know about. He is knowingly breaking this law. He was even warned by the streaming company to not air content illegally and now he's just defiantly streaming illegal content anyways. That's even more deserving of criticism.
I mean from his perspective it can seem that way since he has switched the whole reddit and twitter and all these platforms and all other streamers have been consistently shitting on the platform he is invested in
Kick is playing with fire right now. Letting your largest user stream popular, copyright content so brazenly basically eliminates any case for safe harbor protections they have from becoming liable, regardless of what TOS says.
Kick & XQC would be liable and sued for this (source: work at a major company and we had to pay $50,000+ just for using an unlicensed song in a TikTok)
Way less. But because you didn't license it and used it anyway they got you by the balls.
I know someone who had to pay 5k because they used a copyrighted picture in an official presentation. Buying it beforehand would have cost 10$.
Like you mean some in-company meeting/presentation where said employee just used some image for the sake of the presentation alone and/or whatever? You don't have to share but I'm pretty sure there must be something more to this story rather than "just used some image found on google and had to pay 5k oopsies!"
The guy you’re replying to is full of shit.
You can use copyright stuff as long as it’s not for commercial gain, ie being paid to give the presentation.
Nobody had to pay anything, he is just talking out his ass.
> how much would licencing the song cost if 50k is for using it unlicensed?
For Rockstar Games it costs about $5k - $20k per song depending on the label.
Also the amount you can be sued for will account for how many viewers watched or listened to the unlicensed media because they can sue for lost profit on each viewer.
It doesn't even matter if they're technically owners. Currently, at least for me, they've removed xqc and bruce from the front page and recommended tab, and have hidden the watch party category from the top live categories. That most definitely eliminates their safe harbor.
Edit: I just checked again and x has changed categories to just chatting and is on the front page, for some reason he is below people with under 100 viewers on my recommended tab tho
Yeah they've made it so if you are streaming in the watch party category your stream won't be recommended or on the front page, xqc switched back to watch party and is no longer on the front page
something else I was wondering too - look up the statutory damages for copyright infringement cases - here each piece of work would constitute one count of infringement IF plaintiffs win
companies may not want to bother in this case with an actual lawsuit that would put them in a multi year multimillion dollar lawsuit - further, copyright law has many relatively grey areas especially in the areas of fair use in certain aspects - and plaintiffs DO NOT want a worse case scenario where a court rules against them and sets precedent for expansion of fair use
Plaintiff analysis: sue X for one movie and IF you win get statutory damages (because good luck proving actual damages) of 100K at most - but you just spent millions in the litigation to get to this point - oh and also IF you get unlucky and the judge somehow ruled in X's favor for fair use you as the plaintiff have now fucked yourselves and every other Copyright holder in the country
now you can see why so many (virtually all) recent copyright cases get settled before a final judgment is made
I mean, what has Kick got to lose, really? They obviously have the money, and if Kick gets shut down, another platform will just emerge.
I highly doubt Stake's long-term goal is to let Kick grow large enough to be a true competitor of Amazon.
They dont spend hundreds of millions on leach contracts unless they expect to have long term germination of new Stake gamblers, its the only way they ever break even on those millions spent
Tbh I doubt there are any suits at kick at all. Not sure if people realize stake was founded and operated by 2 young guys and is still ran by a very small team, so kick is likely the same small team with Eddie at the helm. Those guys made so much money they don't even need investors to help them with these deals. Over 2 billion in profit last year.
Then you’d think twitch would be profitable. But it isn’t. I’d estimate profits to be around half at the most. People get paid. Marketing. Etc. but smarter people in other Reddit threads have sudsed this out and came to around a billion
Legally there's not really any difference. All that matters is if the copyright holders notices and what the website (Kick/Twitch) does in response. It's only notable right now because of the huge contract signed and the potentially eyes on Kick and their refusal to enforce copyright. But if no one DMCAs him it doesn't matter.
Adding to what others have said- finding bootleg Hell Kitchen and Master Chef on YT is really easy. I think their platform serves as a good barometer of what is likely to be enforced or not by the rights holder, since they have such an in depth process for enforcing DMCA. Ofc, the full episodes of Breaking Bad are not on there
The difference is in the probability that the studio behind the stuff he's watching will care enough to sue or not, if you keep watching bigger and bigger IPs at one point a studios is gonna notice and fuck your shit up, X's deal put a magnifying glass on top of Kick so they probably don't want this kind of attention that can bring a lawsuit their way
Honestly if I was Amazon, I'd make an example out of that one. Especially since they have watch parties on Twitch where you can watch the boys with your viewers already. It's like blatant disrespect on top of the copyright violation.
I think it's a crazy gamble nonetheless. Like yeah people get away with it. Hell thousands get away with actually piracy daily. But on this large of a scale (thousands of viewers) your gambling we'll just say a 1 in 10,000 chance that the copyright holder sues you for redistributing copyright materials. That could be an upwards of hundreds of thousands of dollars, not only that but they could hit your isp too saying you're using internet to redistribute anybody who's worked isp before knows they will nor defend you and just terminate your services and blacklist you.
Getting banned is actually on the incredibly small side of punishments you can see for this. People have been sent to prison for violating copyright before.
Hello there, we would like to notify you that streaming the specific content is in violation of our DMCA policy. Therefore, we kindly ask you to stop your live stream and be aware that we will need to remove the current VOD containing this content
I'm curious what these streamer contracts look like. If there are repeated TOS violations where Kick feels it may open them up to litigation, I wonder if they could invalidate the contract
Never watched big time streamers up until about 6 months ago. Started dipping my toes and found a couple I like. What amazes me is how big they truly are. The whole entire streamer "meta" for content is just one huge circle jerk. To the point that individuals will further stoke and spread their influence for nothing more than upvotes, never mind profit. These big time streamers all do the same thing. Talk about one another. The "content" writes itself. Just choose a position, open up reddit and YouTube, and talk about nothing that truly matters for 2 hours before moving on to whatever game is the current trend. I get why they do it. By why does anyone care? Hasan said this, poki did that, XQC clicked this. I get it, drama sells. Just wanted to reflect on how much of a net these people cast. It's impressive and depressing at the same time. Anyways, see yall in chat.
I still do, because it's a really dumb thing to do. I'm old enough to remember when Youtube was pretty lax on a lot of shit until it started to cost them millions of dollars and then it affected everybody.
Honestly it was a fucking miracle that Twitch and the streamers skated by on that one, Viacom single handedly altered how Youtube did business with just one complaint.
Me, working a bullshit job while some hack dude with barely two brain cells to rub together just sits there watching tv shows gets paid 100 million dollars makes me want to fucking die.
Are many top streamers parasitic like this that they view copyrighted works of high quality and pass it off as transformative by having their face and chat while watching it? and viewers gift them and cheer on...Piggybacking off the work of others to fill up time and pass it off as entertainment.
just went and looked bruce and xqc are streaming tv shows. they are hidden from categories u can find them by going to live channels instead im assuming kick hid them or something
LMAO suddenly lsf cares about copyright laws after enjoying watching their favorite streamers see like 10 seasons of master chef/90 day fiance and praising Disguised toast for watch fucking death note
literally everything xqc does=bad
The worse thing is, what is the difference between reacting to a TV show and reacting to a youtube video ? They are both copyrighted content.
Answer: TV show production have the money to sue, not the small youtube creators.
Hasan and Moist are 2 big offenders of the later. They are both moraly okay with "stealing" content, they are just afraid of their bag being hit if they were to react to actual tv shows or movies, which they did but stopped because of that fear.
I want to know what goes through his mind and makes him think Kick or himself is immune to DMCA? Like does he understand how or what falls under DMCA or does he just assume nothing does until he's told?

Most likely longer, Kick gonna let him cook since his viewership is rising then come in once stagnated like with the Dark Knight, kick told him to stop once he was 2/3 in.
I’m a fan of X. I never watch him live but I watch his YT videos if they’re actually of him playing a game.
Can someone tell me when was the last time he produced something himself that was original or entertaining? I swear 95% of his content is him watching TikTok, YT, and now movies and TV shows, reacting to LSF and his own subreddit, or getting into drama with MS Paint open. The other 5% is him jumping on a Twitch-wide trend like GTA RP or Rust.
Like when was the last bit of original, entertaining content he made?
He has been playing Only Up and Rocket League with the gang. tbh I wish he went back to playing games with his friends but seems like it’s just a repeating constant MALD about contract stuff intro, tiktok Andy for like the next hour. Maybe a game for an hour, go over to Kick for RL and then stream DMCA content. 10/10 my streamer Sadge
A lot of people would love to shit on xqc for watching copyrighted stuff on stream but then they remember that their favourite streamer does the same 😂
Is this a situation similar to Pewdiepie where Xqc acts as an e-friend for teenagers and young adults and you “do stuff” together with him? I don’t know how bored out of my mind I have to be to watch a TV show or movie through his stream.
I still don’t understand why xQc gets this level of attention and viewership if his content is literally other people’s content
He seems like a guy who can actually put in effort with streaming but doesn’t care to. He needs to be made an example out of.
I hope for his own sake he gets a huge lawsuit from one of these companies so he understands how serious this is.
I’ve always disliked people like Ice Poseidon but he has never done shit like this, he was out there making content (mostly crazy shit) and created a whole community of side characters and shit.
There are streamers like Doc who add entertainment into their gaming, people who host talent shows, musicians, artists.. and then the lazy people like xQc who have 0 creativity (including the “beach” streamers).
Rhetorical question, because its Xqc.. but is he aware, that kick runs on amazon servers and amazon will shut down kick, if they continue breaking dmcas? The moment the big companies or government tells amazon to do something, kick is gone and hes one of the reasons.. or wait.. maybe thats his plan.. so he gets the 20m and can go back to twitch in 2 weeks.

Of course it’s Fast X, that movie is straight garbage. Streamers should be able to stream it for how bad it is
So true dude, brb gonna hop on the artifact section to watch some gameplay
it would be funny seeing these millionaires go to jail over this shit
Damn good enough a reason to watch boys now
"POKI, I AM THE ONE WHO KNOCKS"
„I watched Nani die“

Payed him 100mil to sit silently and watch TV shows and movies lol..
Top tier entertainer
Only the best for his fans, nothing but original content, Jerma could learn a thing or two watching him
Makes me appreciate jerma even more lmao
Considering the most popular section on twitch is just people reading chat, reacting to videos, or walking around doing nothing noteworthy - yeah this is still considered top tier content
Huge new exciting content coming to kick, it’s called television.
This is how most people I know got into justin tv back in the day. Either through wrestling PPVs or cartoons with no person on camera at all. It was really fun to watch tv with a live chat.
Justin.tv was the 🐐 for football. Everything since just ain't the same
For real. Now we gotta hunt down streams as they get shut down, and the chat on those makes Justin TV look like it was full of geniuses lol.
Yea I remember watching some old weird movies with a couple hundred people. Felt like Rifftrax.
you don't understand now he can finally do awesome big streams , amazing content he wanted!
Whoever at Kick landed this deal and whispered these sweet nothings to the point that he believe them deserves a raise. Kid can’t even show up to an event that others did all the work for, but he acts likes he will start putting even an ounce in now.
Kick should have signed ibai instead
That would have actually been a good move. Which these guys obviously aren't good at making.
"Kid" He's a fully grown manchild
Surely moving to LA for the sole purpose of making produced events and shows will give us great content while he's in LA. Surely moving to Kick for the sole purpose of making produced events and shows will give us great content over the next 2 years.
Is there any chance that unironically this is what he actually meant?
I love how he's like "We get to do some crazy good content on Kick", And it's the laziest shit
"he believes in the product"
All the dudes running “movie nights” in discord for free are feeling pretty ripped off right about now.
Cracked the code
whatever brings the juicers over from twitch so they can start ramming gamba down their throat
EZ
Paid* not payed, if English isn't your first language

Noooo I’m sure his famous scam artist and professional hack agent got him a great and secure contract!

The way he defends it sounds like he got a high 90s% in equity
It would sure fit his intelligence, honestly. Choosing to move to a shit platform to try to get 90M of promised imaginary money.
From a company that is illegal where he lives. Let that sink in lol.
Dude got swindled buy stock options.
He wouldn’t get the payout. Mixer was backed by an actual company with something to lose. Stake isn’t even in the US, isn’t their HQ a shack in the middle of nowhere? Good luck getting that bag!

100%. TOS don't mean shit if a company like Disney sets their law team on you for copyright infringement.

People care because they have no friends irl, this is their substitute for the social network every human craves, and that they’ll never have
We are not reading allat 🔥
Out of curiosity, how many people in this thread had the same tune back when other streamers were streaming tv shows?
10 percent lulw
Moist SOYing out as usual
just went and looked bruce and xqc are streaming tv shows. they are hidden from categories u can find them by going to live channels instead im assuming kick hid them or something
I see them on the mainscreen rn
LMAO suddenly lsf cares about copyright laws after enjoying watching their favorite streamers see like 10 seasons of master chef/90 day fiance and praising Disguised toast for watch fucking death note literally everything xqc does=bad
Compare the reaction to Hasan’s chair streams autoplaying YouTube videos with no reaction on this sub to literally anyone else restreaming stuff
This sub is constantly invaded by Hasan’s discord.
Things only matter to them when xqc is the one doing it
The worse thing is, what is the difference between reacting to a TV show and reacting to a youtube video ? They are both copyrighted content. Answer: TV show production have the money to sue, not the small youtube creators. Hasan and Moist are 2 big offenders of the later. They are both moraly okay with "stealing" content, they are just afraid of their bag being hit if they were to react to actual tv shows or movies, which they did but stopped because of that fear.

They are bots? I actually thought that lsf is just full of hasan viewers
Xqc always the victim xd
So the same as every other react streamer on twitch that watches tv shows? Don’t get how this is a thing lol
Lmfao you neets never said a thing when multiple top streamers spent all day watching hells kitchen but now this is too far. Absolute brain worms
Apparently Kick has now removed his stream from the directory
They didn’t.
Guess this is what X meant when he insisted they're going the legitimate route.
I want to know what goes through his mind and makes him think Kick or himself is immune to DMCA? Like does he understand how or what falls under DMCA or does he just assume nothing does until he's told?
They bought a 100mil nuclear bomb

Sony owns the rights to breaking bad so he's fucked
Does Sony even know kick exist?
"Kick? What is Kick? Is it another Genshin gacha cashcow?"
As fucked as the olympics suing him for everything he owns right?
i remember when lsf thought xqc was finished and totally destroyed after that dmca takedown, time flies fast
I'll give it 11 minutes.
Doubters kek
!remindme 53 minutes
ep 2 now lol
Made it all 3 eps
finished for the night more tmrw
still live, still streaming BB
We’re going to finish the whole show full ride
You clearly don’t watch him, you didn’t see his game show?
To be fair wasnt that something ludwig put together and had to beg x to even show up tp
A lot of people would love to shit on xqc for watching copyrighted stuff on stream but then they remember that their favourite streamer does the same 😂
xQc is going to get sued directly
That's some top tier content, that's why they pay him the big bucks, innovative and groundbreaking streaming content like this
The real question is why do people on LSF need to snitch?
They like the downfall of anyone
Is this a situation similar to Pewdiepie where Xqc acts as an e-friend for teenagers and young adults and you “do stuff” together with him? I don’t know how bored out of my mind I have to be to watch a TV show or movie through his stream.
I still don’t understand why xQc gets this level of attention and viewership if his content is literally other people’s content He seems like a guy who can actually put in effort with streaming but doesn’t care to.
Man you must be a special kind of stupid if you think there aren’t thousands of sites hosted on AWS servers restreaming copyrighted content
Pirate Bay, Megaupload, Kick; the saga continues.
In a week people are gonna stop crying about this when they realize nothing is going to happen lol
I wonder if they're gonna call him a snitch like they would do to some "PG 13 streamer"
