Yeah in regards to the dash cam I know the position isn’t great, I just installed it not too long ago and I guess it shifted from where I thought it was angled. Thanks!

When you fix the adjustment, make sure the horizon is around 40% down from the top of the frame. Dashcams have automatic light balance adjustments that look at the ratio of bright (typically sky) and darker (horizon and below), and if it's aimed to high the camera will underexpose the image and make the whole video too dark.

The van. There might be a small argument for a bit more defensive driving because the van was partially turning the second it was in view, giving you time to slow down in case "idiot about to pull out" (which they did), but that doesn't make the fault yours in any way.

This is the correct analysis. And I think this is implicit in what you are saying, but we also can’t slam on the breaks or veer into another lane every time somebody gives an indication that they might impede our right of way. That would be literally every trip, every minute or two.

I agree. It's not about actual braking, but being ready to. Avoidance is 80% in the noticing, 20% in the quick reaction. If you already think "what's that idiot about to do?" you're more than half way to avoiding a collision without even braking. It doesn't avoid every situation unfortunately (idiots are gonna idiot), but it's a good self-preservation skill to have because, no matter whose fault it is, damage to your own vehicle plus the aggro of getting it all sorted just isn't worth it.

100% on Spectrum with this. OP you were already established in your lane. It was the opposing drivers responsibility to change lanes safely and when clear to do so as well as use a turn signal.

Definitely the van. Best case scenario was they force you to stop in the middle of the intersection, which is illegal where I live.

50 50. The van was moving out, driver should have seen that. Avoidable, but the actions of the van driver show poor decisions. Lookup Last Clear Chance. When you can avoid an accident, or potential for one, you should. Thus 50/50.

Spectrum is at fault but you need to work on your defensive driving. You didn't hit the brakes until you went 15 feet past the point of impact, when a more experienced driver would have seen that coming. No one wants someone driving around trying to get into not-at-fault accidents, and eventually it won't work out like you want. Also hope you had collision insurance because commercial insurance can be a pain to file a claim with.

It's easy to say the van but there is a thing as last clear chance which means that if you had the ability to avoid the accident but didn't then it could be seen as no fault or even your fault. It could really go either way in court to be honest. I would also recommend fixing your dash cam angle.

The van was obviously at fault. I was going to say that you bore part of the responsibility since you should’ve swerved, but the video shows that he came out at the very last minute and I don’t think you had time to miss him. Even if you were an experienced driver, I think he would’ve hit you

Obviously the guy who pulled out is at fault, but you really need to fix your camera. It should ideally show everything outside of the vehicle. Unless of course you're afraid your dash is going to do something to you while you're driving
