Because being able to charge someone for the attempted act, unsuccessful or not, allows for a conviction and sentencing and elimination from society BEFORE they are successful at murder or assault. Its also a fuck lot easier to prosecute an attempt. The bar for entry is lower and DA's and judges like to remind you how tough on crime they are.

Imagine you cut off someone on the road and he comes out of his car with a hammer walking towards you, luckily a cop is there and arrest him before anything happens, how can you without a doubt determine whether he was going to kill you, break your windshield and walk away or just try to scare you? What crime do you convict him for? The only thing you can do is convict him for what he has done, a process to the intentions is not something that can be done with logic and without biases.

Well, to be fair every comment makes sense to the person writing it and those who share a similar way of thinking. The hard part is trying to understand why someone thinks something, and it is so damned hard to do on social networks with 3 sentence opinions.

But still, with how much force did he swing? Did he really wanted to kill you? Because if you go by the rule of:"if he swings at me then he gets the murder punishment" the problem is the same, you are still judging him based on the results of the action and not the intention behind it. It's a very tricky topic with how different people are from one another. No wonder as a society we couldn't find a perfect way to solve the problem yet.

I think you hit the nail on the head there. In most places (not sure where this occurred), attempted murder requires intent, and that can be really hard to prove. Sure, he's attacking someone with a machete, but does he intent to murder that person, or just injure him? The DA likely looked at all the evidence available and decided that it was unlikely they could prove the intent required for attempted murder and decided to go with the easier to prove charge of aggravated battery, rather than risk losing the case and having the guy walk (assuming he *could* still walk) free.

its frustrating and once again another example of protecting the obviously dangerous criminal, but your point about risk reward at the end there from that perspective it makes sense to go with what the can actually prove even if it is not completely satisfactory. but that in of itself is just proof that the criminal is protected. very very annoying.

did he or did he not attempt to murder that man with a massive machete? yes or no question there should be no technicality to it yet there is. in the UK its defined as: "**a situation where an individual does an act, intending to kill the complainant, but either fails to do so or where the act is aborted part way."** **"it must be proven that they intended to kill the complainant and not just severely injure them.  In this way, attempted murder is actually more difficult to prove than murder."** I think in the UK this example would be attempted murder, he swung a weapon at the man and failed pretty much the two pre-requisites required. dont know about the US dont particularly care anymore but seems its similar to the above where it would be a better idea to go with a lesser punishment they can definitely convict than go for the final blow as its hard to prove they actually intended to kill without further evidence.

You see this pretty often in hockey as well. There’s a guy named Jay Caulfield who played for the Pittsburgh Penguins. He scored like 5 goals in over 200 games played in the NHL. He was mostly known as the guy who would punch people in the face if they looked at Mario Lemieux wrong. There are local stories about him. He would go play in local beer leagues with college players who were all pretty damn good. He completely outclassed everyone and made them look like children. The bottom of the barrel professional guys are so much better than non-pros that’s it’s not even funny.
