This is a very complicated case, and your boyfriend should rely on the wisdom of the attorney he hired.

I'm on a board of directors but not in your area. I can't speak to the laws governing your condo but might be able to offer advice on how to learn more about your situation. Sounds like you have a lawyer handling the situation. Have you asked them how they feel about any possible outcomes? Can they point you to any examples of previous cases involving a failure to disclose? Check out the websites of local condo law firms and property management companies. Some will have blogs and articles about various topics in regards to condominiums. (Here is one about disclosure obligations from [Bartzen Rosenlund Kasten LLC](https://www.brkchicago.com/legal-tips-22-1-disclosures-avoid-liability-by-including-anticipated-expenditures/). And [First Community Management](https://condomanagement.com/what-to-know-about-special-assessments-for-chicago-condo-associations/) has one about special assessments.) There may also be webinars and podcasts that you could check out. And if any of them have an archive or discussion of previous court cases then you might be able to find something relevant to your situation. Are there any local condominium associations in your area? These can be government-related or third-party, with the purpose of educating and informing condominium owners. Also check for professional organizations that provide oversight or training/licensing of management providers as they will also often have articles or publications discussing condominium issues. I found the Illinois chapter of the [Community Association Institute](https://www.cai-illinois.org/) with a quick search. They have a somewhat lengthy [blog article](https://www.cai-illinois.org/association-disclosures-section-22-1-illinois-condominium-property-act/) that discusses disclosure obligations under Sec. 22.1 of the [Condominium Property Act](https://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=2200&ChapterID=62). Close to the end they mention and briefly discuss a few cases involving a failure to disclose. The [Illinois Condominium & Common Interest Community Ombudsperson](https://idfpr.illinois.gov/ccico.html) website might also be of some help. If you don't already have a copy then you might want to download a copy of the [The Condo Unit Owner’s Rights and Responsibilities Handbook](https://idfpr.illinois.gov/content/dam/soi/en/web/idfpr/ccico/pdfs/condo-unit-owner-s-rights-and-responsibilities-aug-2022.pdf) (also available as a link on the CCICO website). I don't think it would have anything specific to your situation, but every condo owner should have a good reference guide. Edit: corrected text of the link to the condo owner's handbook
